Deputy fire chief placed on paid leave after harassment complaint
A high-ranking Toledo Fire & Rescue Department officer is on paid leave after being accused of sexually harassing behavior. Deputy Chief Danny Brown-Martinez is the subject of an ongoing internal investigation and is on paid administrative leave pending the outcome, said Sheldon Collins, a department spokesman. “Consistent with departmental policy and the collective bargaining agreement, the department will not comment on the specific allegations, circumstances, or details of an ongoing internal investigation,” Mr. Collins said. City spokesman Amy Voigt had no further comment Friday about the disciplinary proceedings. Peter Pattakos, lawyer for Chief Brown-Martinez, said the allegations arose while his client was on medical leave and involve an accuser with an incentive to lie about him. “This involves a public servant with nearly 30 years of exemplary service and no prior disciplinary history,” Mr. Pattakos said. “...There are substantial concerns about how this matter has been handled and whether he has been afforded due process and a fair opportunity to respond.” The attorney said he expects Chief Brown-Martinez to ultimately be vindicated of any wrongdoing.

Man accused in fatal shooting outside Toledo homeless shelter found incompetent to stand trial
A man accused of killing another man outside St. Paul’s Community Center late last year has been found incompetent to stand trial in Lucas County Common Pleas Court. Judge Ian English on Tuesday ordered Al Alim Zaki-El, 58, transferred to Northwest Ohio Behavioral Healthcare’s Toledo campus after two doctors’ reports advised a “substantial probability” exists that he could be restored to competency within a year if provided a course of mental-health treatment. Mr. Zaki-El was arrested Jan. 26 for the Dec. 26 shooting death of Andrew Shively, 36, outside the homeless shelter on 13th Street. Authorities said upon his arrest that he lived in Detroit, although the Feb. 4 indictment charging him with alternative counts of murder and felonious assault listed his residence as St. Paul’s. The judge’s order followed reports submitted to the court Sept. 20 by Timothy Wynkoop and Sunday by Dr. Jonathan Sirkin that found Mr. Zaki-El incapable of assisting with his own defense. The judge continued Mr. Zaki-El’s bond at $1.25 million and directed the hospital to advise the court if his condition deteriorates.

Another lawsuit filed over North Toledo chemical leak
Another lawsuit been filed in the aftermath of last month’s airborne chemical leak from MC Tank Transport in North Toledo. The latest case involves eight plaintiffs of record. Molly A. Ebraheim, an attorney representing them, said more are likely to be added as part of an amended complaint. “We are not bringing it as a class action. We are bringing it as a multi-plaintiff claims case,” she said. “Our clients are just choosing to bring their own individual claims.” Ms. Ebraheim is one of three attorneys in the Maumee office of Nurenberg, Paris, Heller & McCarthy Co. who are working on that case. A 19-page complaint they filed in Lucas County Common Pleas Court states that each of their clients “suffered harm different in kind from that suffered by the general public, including displacement costs, lost wages, medical treatment, and property impacts.” The plaintiffs are Larry Sanchez, Kenyada Hooks, Kapreece Sims, Eric Walker, Bryan Smith, Felix Abalos, Michael Sims, and Timothy Myers. All are from Toledo except Michael Sims, who lives in Sacramento, and Mr. Myers, who lives in Eastlake, Ohio. The latter two were traveling through Toledo when the release began on the night of Oct. 20, and were

New Toledo police chief takes reins amid budget challenges
Michael Troendle, who retired Nov. 1 as Toledo police chief, reflected for a moment about not being the city’s top cop anymore. “It’s a surreal feeling after being in the department for 33 years,” he said. “This has been my entire adult life.” Kevin Braun, previously assistant chief, took over as chief Nov. 2. “Change is good,” Mr. Troendle said. “Chief Braun will have newer ideas. That is a good thing. Me leaving opens up opportunities for some of our younger officers to be promoted. You’re breathing in new blood, and that’s a good thing for an organization. I’m excited to see what Kevin does with the department.” Chief Braun, 47, called his new job challenging. “We’ve been lucky enough to have a three-month transition period from the time of the announcement in July,” Chief Braun said. Mr. Troendle has been his mentor, he said. “We worked so closely together. So the transition period was much longer than three months,” Chief Braun said. “I feel about as prepared as a person could feel going into a job. But the reality is, I’ve never been chief here before. I still have a lot to learn.” Top priorities Chief Braun said his
