New authority takes shape for Timbers Town Center redevelopment
A new community authority overseeing the $89 million redevelopment of the former Shops at Fallen Timbers in Maumee has approved an agreement outlining responsibility for maintaining streets and sidewalks at the shopping center. The Timbers Town Center Community Authority’s seven-member board of trustees approved the infrastructure maintenance agreement at its organizational meeting Thursday, along with bylaws and other measures establishing how the authority will operate. Under the agreement, the city would take over the development’s streets and sidewalks, while the developer would remain responsible for their upkeep. The authority could help cover some of those maintenance costs. The agreement comes as Timbers Town Center Ltd., a consortium of developers with ties to Columbus’ Easton Town Center, prepares to revitalize the struggling shopping center. The group purchased the property in July for $17.3 million and plans to invest approximately $89 million, including the acquisition cost, in the redevelopment. Plans include repairing deteriorating streets and sidewalks, attracting new retail and restaurant tenants, and potentially adding about 230 apartments. Much of the redevelopment work is expected to take place in 2027. Greg Daniels, an attorney for the development consortium, said the new authority will oversee financing matters and determine how its funds are

Man accused in fatal shooting outside Toledo homeless shelter found incompetent to stand trial
A man accused of killing another man outside St. Paul’s Community Center late last year has been found incompetent to stand trial in Lucas County Common Pleas Court. Judge Ian English on Tuesday ordered Al Alim Zaki-El, 58, transferred to Northwest Ohio Behavioral Healthcare’s Toledo campus after two doctors’ reports advised a “substantial probability” exists that he could be restored to competency within a year if provided a course of mental-health treatment. Mr. Zaki-El was arrested Jan. 26 for the Dec. 26 shooting death of Andrew Shively, 36, outside the homeless shelter on 13th Street. Authorities said upon his arrest that he lived in Detroit, although the Feb. 4 indictment charging him with alternative counts of murder and felonious assault listed his residence as St. Paul’s. The judge’s order followed reports submitted to the court Sept. 20 by Timothy Wynkoop and Sunday by Dr. Jonathan Sirkin that found Mr. Zaki-El incapable of assisting with his own defense. The judge continued Mr. Zaki-El’s bond at $1.25 million and directed the hospital to advise the court if his condition deteriorates.

Beverly development decision delayed after community testimony
Final approval was postponed Thursday on a plan from Maumee Valley Habitat Humanity to build nine houses on a South Toledo lot. “Would you consider deferring this case for 60 days so that you can ... not just go to previously scheduled meetings, but actually work with the plan commission staff to schedule a public meeting specifically about this project?” Brandon Rehkopf, chairman of the Toledo City Plan Commission, asked the CEO of the nonprofit. “Let the neighborhood come and answer questions and then consider based on the feedback if there are any potential amendments in this plan for this body to consider,” he said. The plan commission’s meeting Thursday was conducted before a pretty close to full house of attendees at One Government Center. Many attending the meeting were residents of the Beverly neighborhood where the houses are set to be built. The project is on the site of the old Beverly Elementary School at 4022 Rugby Dr. That building was torn down in 2012 and the land has been vacant since. Of the nine houses, two would be sold on the open market while the other seven would be sold to Habitat homeowners through the organization’s homeownership program.

Another lawsuit filed over North Toledo chemical leak
Another lawsuit been filed in the aftermath of last month’s airborne chemical leak from MC Tank Transport in North Toledo. The latest case involves eight plaintiffs of record. Molly A. Ebraheim, an attorney representing them, said more are likely to be added as part of an amended complaint. “We are not bringing it as a class action. We are bringing it as a multi-plaintiff claims case,” she said. “Our clients are just choosing to bring their own individual claims.” Ms. Ebraheim is one of three attorneys in the Maumee office of Nurenberg, Paris, Heller & McCarthy Co. who are working on that case. A 19-page complaint they filed in Lucas County Common Pleas Court states that each of their clients “suffered harm different in kind from that suffered by the general public, including displacement costs, lost wages, medical treatment, and property impacts.” The plaintiffs are Larry Sanchez, Kenyada Hooks, Kapreece Sims, Eric Walker, Bryan Smith, Felix Abalos, Michael Sims, and Timothy Myers. All are from Toledo except Michael Sims, who lives in Sacramento, and Mr. Myers, who lives in Eastlake, Ohio. The latter two were traveling through Toledo when the release began on the night of Oct. 20, and were
