Consider this scenario: You are defrauded by a company and its CEO. You sue both in state court and, after three years, a jury awards you millions in damages against both. But as the state court judge is finalizing the judgment, the company files bankruptcy. Does the bankruptcy filing nullify the state court lawsuit? And does the company’s bankruptcy automatically protect the CEO? A recent order from the United States Bankruptcy Court for the Western District of North Carolina tackles both questions – and plaintiffs will like the answers. Background Systematic Audio and its manager, Scottie Johnson, spent three years defending a lawsuit in Catawba County. After a three-week trial, a jury found Johnson personally liable for fraud and interference with contract, awarding over $5 million in compensatory damages and more than $16 million in punitive damages. But before the state court judge could enter a final judgment, Systematic Audio filed Chapter 11, triggering the automatic stay on efforts to collect from the company. The company then asked the Bankruptcy Court to extend the stay to collection efforts against Johnson on the theory he was too important to the business to be distracted by litigation. Gaston County board approves new property values; residents react

Following a deadlocked debate and intense public scrutiny, the Gaston County Board of Commissioners voted 4-2 Friday afternoon, Oct. 30 to pass the 2027 Schedule of Values, officially establishing the framework for how local real estate will be assessed in the upcoming reappraisal. The decision came during a swift 45-minute special meeting at the Gaston County Courthouse, reversing a 3-3 tie on Oct. 27 that had stalled the measure. Commissioner Tom Keigher made the motion to approve the schedule, with Vice Chair Bob Hovis providing the second. Joining Keigher and Hovis in voting yes were Chair Chad Brown and Commissioner Allen Fraley, whose absence on Oct. 27 had left the board in a stalemate. Commissioners Cathy Cloninger and Scott Shehan stood firm in opposition, voting no for a second time. Jim Bailey was not present due to a family matter. When contacted after the meeting, he affirmed his no vote from the previous meeting. The Oct. 30 vote ensures the county meets state statutory deadlines to adopt the property valuation rules before Jan. 1, avoiding potential revenue impacts and keeping the tax appraisal schedule on track. Groups call on NC county to reject rezoning for Duke Energy project

On Monday, the Davidson County Planning Board will decide whether to rezone hundreds of acres along the Yadkin River for a new Duke Energy project. Opponents contend it will harm surrounding communities and the environment. A Duke Energy subsidiary wants to build its Davie-Davidson Energy Complex along the Yadkin River, which requires major infrastructure and rezoning approvals. Davie County officials certified two proposed methane power plants as public utilities, allowing Duke Energy to build on land zoned residential and agricultural. The decision was made without a public hearing or special use permit. Davidson County officials voted in favor of rezoning land for a liquid natural gas storage facility for heavy industrial use. A final vote is scheduled for Monday. Nicole Eastman, Yadkin Riverkeeper, argued the facility isn't a public utility and said such a project should only be built in areas zoned for heavy industrial use. "It really doesn't make sense for two massive power plants that would draw a lot of water from the Yadkin River, and also would be discharging back into the river and contributing to air pollution," Eastman stressed.
