Prairie Band’s dispute with Kansas Lottery won’t see trial before 2028
A potential trial on the disputed size of the Prairie Band Potawatomi Nation’s reservation won’t happen before 2028, according to federal court records. U.S. Magistrate Judge Angel Mitchell issued a scheduling order Nov. 3 for the Prairie Band’s lawsuit against Kansas Lottery executive director Stephen Durrell. The lawsuit involves lottery sales on land, including portions of west Topeka, the Nation is laying claim to via a 1846 treaty. A notable deadline involves motions to intervene, which are due Jan. 8. The City of Topeka has considered joining the lawsuit , and the expectation is that others may want to join as well. “The parties anticipate that municipality and county governments in the affected area — the 30-by-30-mile square that the Nation claims as its reservation — as well as perhaps others with interests in this dispute may seek to intervene in this action,” the scheduling order said. “Plaintiff intends to oppose any motions to intervene.” More: July 27 trial set in $2.25M Potawatomi suit against feds The Prairie
