The Tesla owner reported the incident on the Tesla Motors Club forum, where he explained how his car, which was in “Full Self-Driving (FSD mode),” put him in a dangerous position as it drove directly towards closed level crossings on two separate occasions, one of which he captured on video that has since gone viral across social media.

In his report, the Ohio man, who did not specify the model of his Tesla, said it was in FSD mode at the time and didn’t slow down despite the train crossing ahead of his speeding car. He said, “I have owned my Tesla for less than a year, and within the last six months, it has twice attempted to drive directly into a passing train while in FSD mode. The most recent incident occurred on May 8, 2024, and I have dash cam footage from that event.”

The video shared by Doty shows his speeding car headed directly toward a moving train and him eventually intervening while the FSD mode was engaged. Just before colliding with the moving train, the Ohio man grabs the wheel of his self-driving Tesla and turns it to the right after smashing through the railway crossing sign, stopping just a few feet away from the still-moving train.

Doty said, “I am trying to obtain the telemetry data from these incidents. Additionally, I am looking for similar cases or incidents. Unfortunately, I haven’t been able to find a lawyer willing to take my case due to the lack of significant injuries — only backaches, and a deep bruise on my right elbow, which didn’t require medical attention.”

Tesla has faced numerous other lawsuits from owners claiming that their cars engaged in FSD mode or Autopilot caused them to crash because they didn’t stop for another vehicle or swerved into an object. In some cases, the accidents resulted in lives lost.

Additionally, Tesla has previously cautioned drivers against using FSD mode in low light or poor weather conditions like rain, snow, fog, and direct sunlight, claiming it can “significantly degrade performance.”

According to the National Highway Traffic Safety Administration (NHTSA) , as of April 2024, Tesla models Y, X, S, and 3 Autopilot systems were involved in a total of 17 fatalities and 736 crashes since 2019.
