Diddy Files Motion to Dismiss Parts of Sexual Assault Lawsuit

Diddy seeks dismissal of some claims in a sexual assault case, citing the non-existence of laws during the time of the alleged incident.

According to court documents , the mogul has requested to dismiss the third, fourth, fifth, and sixth cause of action against him with prejudice. He acknowledges that the Adult Survivors Act has revived specific claims for which the statute of limitations has run. However, he argues that the act does not allow a plaintiff to revive claims under laws that did not exist when the misconduct allegedly occurred. As previously reported, Joi Dickerson-Neal filed a lawsuit against Diddy in November, claiming he drugged and sexually assaulted him in 1991.

Furthermore, the four laws upon which the plaintiff bases their claims were passed years after the alleged incident and cannot be retroactively applied to the alleged behavior without clear legislative intention. His lawyer also noted that the lawsuit was filed under the New York Services for Victims of Human Trafficking Law, which wasn’t in effect until 2007.

Diddy’s legal team has cited the 2019 New York State Revenge Porn Law and the New York City Victims of Gender-Motivated Violence Protection Law, which came into effect in 2000. They have requested that the motion to amend the complaint, based on the causes of action, be denied. They have argued that the amendments would be pointless since the nonexistence of corporate entities at the time of the alleged incident cannot be rectified.

The lawsuit also listed Bad Boy Records and Bad Boy Entertainment, but Diddy’s legal team says Dickerson cannot sue the companies because they didn’t exist in 1991. A statement from either parties have yet to be released.
