BISMARCK, N.D. ( KXNET ) — Prosecutors in Bismarck are currently waiting to find out if a man will face trial for the brutal attack of a woman at her home.

Edward Harper was arrested for the rape and assault of a woman in December after police say he followed her home and forced himself on her.

This week, Harper was in court for a status conference to discuss whether or not he is mentally fit to stand trial. According to the court order, there seems to be an issue of whether or not he has the fitness and ability to proceed.

Harper remains in custody but was taken to the State Hospital in Jamestown to be evaluated.

There, he will be monitored for up to thirty days by mental health professionals. He has another status conference to reassess his mental fitness scheduled for May 16.
