Vermillion PD: Shooting death occurred after unlawful entry, was in self-defense

VERMILLION, S.D. (KCAU) — The Vermillion Police Department said that the deadly shooting took place after a man “unlawfully and forcefully entered” a home.

In a release, the police department said they received a report of a shooting Tuesday at 11:58 p.m. Officers arrived to find a man suffering from a gunshot wound and began lifesaving efforts until EMS arrived. After 30 minutes of effort, the man died at the scene .

The South Dakota Division of Criminal Investigation, Vermillion Police Department, and the Clay County Sheriff’s Office then investigated the incident, including interviewing witnesses and an autopssy.

Authorities learned that when the 911 call came in, Chase Kinchen, 38, of Vermillion, had unlawfully and forcefully entered a residence armed with a handgun, the release said. Kinchen had entered the residence in violation of a protection order “prohibiting him from contact with the resident or from entering a zone of 500 feet surrounding the home.”

Inside, Kinchen allegedly threatened the resident and a guest. The guest ran to an attached garage with Kinchen in pursuit. The release said Kinchen shot at the guest, who was able to get a handgun from a vehicle in the garage and returned fire, hitting Kinchen who later died.

The identity of the guest is not being released, protected under Marsy’s law .

The police department said that everyone involved in the incident have been identified and are cooperating. The investigation is ongoing. Vermillion Police Chief Crystal Brady told KCAU 9 that the shooting is believed to be in self-defense .
