Toledo man found incompetent to stand trial in Fulton County attempted murder case

WAUSEON — A Toledo man charged here in Fulton County Common Pleas Court with attempted murder has been found incompetent to stand trial.

Thomas Justen III, 73, Toledo, was declared incompetent on charges of attempted murder, a first-degree felony; two counts of felonious assault, each a second-degree felony; two counts of strangulation, second- and third-degree felonies; abduction, a third-degree felony; and domestic violence, a first-degree misdemeanor.

Visiting Judge Jonathan Hein made the ruling based on a report from the Court Diagnostic Treatment Center, Toledo. According to court documents the judge ruled that Justen is “incompetent to stand trial” and “there is not a substantial probability” he “will become competent to stand trial within one year.”

Treatment alternatives and where to place Justen will be determined at a later time.

The charges against Justen relate to an incident on Oct. 24 in Swanton where he allegedly attempted to cause the death of another person. The indictment also alleges that he caused, or attempted to cause, serious physical harm, restrained the liberty of another person and caused, or attempted to cause, physical harm to a family or household member.

Justen is represented by attorney Jane Roman of Toledo.

He is subject to the terms of the Corrections Center of Northwest Ohio’s GPS electronic monitoring program, and can only leave his home for medical treatment.
