Heather Ann Dibert, 43, of Duncansville, is facing 32 felony charges and seven misdemeanors for allegedly hiring 34-year-old Zachery Sellers, of Lewistown, to burn down the home her estranged wife was staying at with five others, telling him to “kill them all.”

Jamie Eugenia Beers, 33, of Lewistown is facing a slew of conspiracy charges related to the attempted homicide of Dibert’s estranged wife’s family after she allegedly drove the getaway car that night.

On Wednesday, May 8, Dibert was in Bedford County Court asking for her $1,000,000 bail to be reduced. That request was denied.

According to defense attorney Mark Zearfaus, Dibert and both of her parents testified at the bail hearing requesting a reduction in her bail amount. Her parents told the court she could live with them and Dibert said she would work and abide by the conditions of bail.

Zearfaus said he asked the judge to reduce her bail to $100,000 or even $200,000 so that bail could be obtainable through a bail bond company.

According to the criminal complaint filed by Pennsylvania State Police, Dibert gave Sellers money and drugs to come to Napier Township and burn down the home just after midnight on Oct. 28. Police said that while this was happening, Dibert was setting up an alibi by traveling to a club in West Virginia.

Sellers was arrested by PSP Lewistown on Tuesday, Dec. 12, and allegedly admitted that Dibert offered him drugs and money to burn the house down.

According to Bedford County district attorney Ashlan Clark, the commonwealth opposed any reduction of Dibert’s bail.

“It is our position that bail is appropriately set given the seriousness of the allegations and her past history of assaultive behavior. We did request that there be additional non-monetary conditions imposed in the event that she one day may be able to post bail. The Judge granted those additional conditions that if released, will require her to wear a GPS monitor and report to the probation office for random visits.”

Bedford County District Attorney Ashlan Clark said in a statement

    Previous stories on Dibert:

The conditions that were added on Wednesday are in addition to the previously imposed non-monetary conditions regarding no contact with the victims.

Zearfaus said he also advocated for the GPS monitoring stating that it would protect his client from false accusations should she post bail. With the GPS, Zearfaus added that no one could claim she was somewhere when she wasn’t.

Dibert remains in Bedford County Prison with bail set at $1,000,000.
