    Attorney general files motion to dismiss revealing grand jury evidence case against journalists, BOE board member

    UPDATE: This post was updated to include that Sherry Digmon’s alleged ethics violations case was also dismissed.

    The state of Alabama, through its assisant attorney general, today filed a motion to dismiss the case against two local journalists and a board of education member who are accused of allegedly revealing grand jury evidence.

    According to court records, Assistant Attorney General Thomas Govan filed a motion to nol pros and dismiss the case against Atmore News Publisher and Co-Owner Sherry A. Digmon, 73, of Atmore, and Reporter Don Fletcher, 69, ans District 4 Board Member Cindy Jackson.

    According to Advance archives, Digmon and Fletcher were arrested Oct. 27, 2023 for allegedly revealing grand jury evidence in the newspaper’s Oct. 25, 2023 edition. In the Oct. 25 edition, subpoena and COVID checks were mentioned and names were noted.

    Also arrested some time later included Veronica Fore, Escambia County Schools System payroll clerk. Whether Fore received the same notice of dismissal isn’t known at this time.

    According to Advance archives, Retired 19th Circuit Judge Ben Fuller set a new hearing date April 10 to address motions to dismiss in the case of the area journalists and county board of education members.

    Additionally, Digmon, who was also arrested and indicted on alleged ethics violations for using her office for personal gain, and was served an impeachment indictment from her capacity as a member of the BOE, had her ethics case dismissed as well.
