Top Cop Arrested for DWI After Crashing Car and Refusing Testing
By Mark Parolisi,
Last Thursday evening, Lieutenant Daniel Treacy of the Yonkers Police Department was in an off-duty accident operating his personal vehicle. He drove through a retaining wall and into the front lawn of an apartment building in Bronxville. Lt. Treacy was unwilling to submit to a breathalyzer test, a diagnostic device typically used to estimate blood alcohol content. Bronxville Police Officers arrested Treacy for Driving While Intoxicated (DWI).
On Thursday, April 11 around 11:30 p.m., Lt. Treacy lost control of his grey Jeep while driving on Midland Avenue. He careened over the sidewalk and towards the apartments at 2 Alden Place. There were no reports of personal injuries, but the damage to the brick and stone retaining wall was catastrophic. You may view a short video documenting the damage by accessing the link below.
Arrest and duty status
Bronxville Police arrived on the scene and assessed Lt. Treacy's condition. Per their report, they observed impaired speech and motor conditions, glassy eyes, and an odor of alcohol. However, Treacy refused to submit to a test for intoxication both at the crash site and the station. Therefore, police issued Treacy two citations supported by the Bronxville Police Department's D.W.I. Supporting Deposition And Bill of Particulars. The first being the traffic infraction of §1194.01(b) “ would not take a screening test “. The second being a misdemeanor §1192.03 “Operating a vehicle under the influence of alcohol or drugs.”
The arrest records do not indicate the location from which Lt. Treacy was traveling nor the destination. Though, sources report witnessing him at an Irish pub near the accident.
Lt. Treacy's DWI citation and failure to submit to testing may result in the suspension of his driver's license. Currently, his license is not suspended as per NYS DMV. Pending the results of the Bronxville Police investigation, and YPD's Internal Affairs investigation, “he is not permitted to operate any City of Yonkers vehicle” according to the YPD's Public Information Officer (PIO).
The PIO also confirmed that for now, Treacy remains in his “administrative capacity as Lieutenant of the 2 nd Precinct until the findings of the investigations are complete”.
Lt. Daniel Treacy is scheduled for arraignment before the Village Justice Court in Bronxville on Wednesday, May 1, 2024.
*Correction: The initial version of this story stated sources observed Lt. Daniel Treacy at a retirement party near the accident site. Additional sources confirm the presence at a local Irish pub, but it may be unrelated to a retirement party.
