Wichita Falls Police make another gang injunction arrest over the weekend

WICHITA FALLS ( KFDX/KJTL ) — Officers with the Wichita Falls Police Department made another gang injunction arrest over the weekend.

Twenty-eight-year-old Jaylon Flemming was arrested for the unlawful possession of a firearm by a felon and for a violation of a court order, enjoining organized criminal activity on Monday, April 22.

This was Flemming’s fourth charge of a violation since 2019.

Around 3 a.m. on Monday, Wichita Falls night patrol officers stopped a Dodge truck for a traffic violation when they noticed the passenger was making nervous movements as if possibly hiding something.

The officers found a .25 semi-automatic handgun underneath the passenger seat.

Then, a background check on Flemming found that he was not only a convicted felon but also on a gang injunction, and he had violated three rules on the injunction.

However, WFPD only charged him with one charge for violating the gang injunction as opposed to going with three.

Sergeant Charlie Eipper with the WFPD said that the gang injunction is essentially a lawsuit against certain people in gangs, which comes with rules.

“So, if they violate a law that’s also in there, you can actually double dip and charge them not only with, say, possession of marijuana, but also violation of the gang injunction. The violation of the gang injunction is a Class A misdemeanor. If you can also sue them later on in our county court of law of one or two, you can sue them later for each of those violations.”

Eipper added the objective of the injunction is to suppress gang activity and that the charge for violating the injunction comes with a $1,000 fine and 30 days in jail.

The injunction is also not affected if it is violated as the expiration date is set and does not change.
