    Attorneys of Warren fatal fire suspect ask court to dismiss indictment

    WARREN, Ohio (WKBN) – Attorneys representing one of the defendants facing a capital murder charge in connection to a deadly fire in Warren last year have asked the court to dismiss the indictment.

    Brendan Daviduk is facing a number of charges including aggravated murder stemming from the January 2023 fire that killed Chassidy Broadstone.

    In a motion filed Friday Daviduk’s attorneys say the indictment fails to “present a proper death specification” and it doesn’t “meet the constitutional requirements for specificity and clarity.”

    They claim it insinuates “two inconsistent theories” that accuse Daviduk of either being the main offender or an accomplice who acted with prior calculation or design.

    Prosecutors were given two weeks to respond to the motion.

    Daviduk is due back in court on May 30th.
