TROY (WWJ) -- A Shelby Township man tested at more than three times the legal limit to drive, according to police, after he was arrested at the scene of a crash in Troy.

At 6 p.m. on Tuesday, March 19, Troy Police officers responded to a report about a crash in the area of John R. Rd. at E. Wattles Rd.

Officers spoke with the at-fault driver, identified as a 36-year-old Shelby Township man, and noticed "there was a strong odor of alcoholic beverages coming from his person," according to the police report.

Officers noted that the man was unsteady on his feet, appeared confused, and his eyes were red and glassy, police said. In the driver’s vehicle, officers found two open containers that both appeared to contain whiskey.

After failing a series of field sobriety tests, the man was arrested and taken to the Troy PD lockup where a chemical bread test showed his BAC was .34%.

The driver was issued a citation for Operating with a Blood Alcohol Content of .17% or more and Open Intoxicants in a Vehicle, police said.

Under Michigan's "Super Drunk Laws," drivers with a BAC more than twice the state's legal limit of .08% may face stiffer penalties, including up to 180 days in jail.

The man's name was not released.
