Editorial: Mistaken arrest in mass shooting
The mass shooting June 6 at the Old West End Festival wounded 12 people and terrorized Toledo until the quick arrest of two suspects appeared to move the story from crime to punishment. That assumption came to a screeching halt Friday. All charges against 20-year-old Eljay Crisp-Carr were dropped, and he was released from Lucas County jail. Evidence from Crisp-Carr’s cell phone proved his precise location at the time of the shooting was in the 2000 block of Glenwood Avenue, not at the festival site — as the defendant had claimed from the start. Read more Blade editorials Crisp-Carr had been charged with 25 counts of attempted murder, 26 counts of felonious assault, and other charges connected to gang activity and a probation violation for a previous gun crime conviction. Because the charges against him were so serious, Crisp-Carr was held without bail from his arrest June 11 to his release Friday. Crisp-Carr was mistakenly identified as the shooter by Toledo Police detectives from cell phone photos showing a masked man with the same hairstyle as Crisp-Carr. That mistake is likely to cost Lucas County taxpayers the proverbial pretty penny. According to a statement from Lucas County Prosecutor Julia Bates,

New authority takes shape for Timbers Town Center redevelopment
A new community authority overseeing the $89 million redevelopment of the former Shops at Fallen Timbers in Maumee has approved an agreement outlining responsibility for maintaining streets and sidewalks at the shopping center. The Timbers Town Center Community Authority’s seven-member board of trustees approved the infrastructure maintenance agreement at its organizational meeting Thursday, along with bylaws and other measures establishing how the authority will operate. Under the agreement, the city would take over the development’s streets and sidewalks, while the developer would remain responsible for their upkeep. The authority could help cover some of those maintenance costs. The agreement comes as Timbers Town Center Ltd., a consortium of developers with ties to Columbus’ Easton Town Center, prepares to revitalize the struggling shopping center. The group purchased the property in July for $17.3 million and plans to invest approximately $89 million, including the acquisition cost, in the redevelopment. Plans include repairing deteriorating streets and sidewalks, attracting new retail and restaurant tenants, and potentially adding about 230 apartments. Much of the redevelopment work is expected to take place in 2027. Greg Daniels, an attorney for the development consortium, said the new authority will oversee financing matters and determine how its funds are

Man sues for $20 million after Old West End shooting charges dropped
Attorneys for Eljay Crisp-Carr, who was accused of participating in a gunfight at the Old West End Festival in June, have filed a $20 million federal lawsuit against the city of Toledo and Lucas County after prosecutors dropped the charges against him Friday. The complaint, filed Tuesday in U.S. District Court for the Northern District of Ohio, Western Division, alleges unconstitutional arrest, detention and searches, malicious prosecution, misleading identification evidence, and failure to disclose information concerning another suspect. Crisp-Carr is seeking $10 million in compensatory damages and an additional $10 million in punitive damages. On Friday, Jennifer Liptack-Sutphin, the chief of criminal prosecution for the Lucas County Prosecutor’s Office, told Judge Lori Olender in Lucas County Common Pleas Court that because of “new and developing evidence,” the charges against Crisp-Carr, 20, should be dismissed. The shooting happened in front of the Agnes Reynolds Jackson Arboretum at Delaware and Robinwood avenues, a busy part of the festival where several food trucks were parked. During a June 18 court hearing , Toledo Police Detective Danielle Mooney estimated there were at least 75 to 100 other people in the proximity of the gunfire. She told the court that, at that point in the

School tax votes split: Cuts loom for two districts
Maumee and Springfield schools are bracing for major budget cuts after voters rejected proposed income taxes Tuesday, while voters in Toledo and Sylvania approved additional funding for their school districts. In October, Springfield Superintendent Matt Geha told members of the board of education the district would have to cut $500,000 from the budget even if the income tax measure passed. He warned that number could rise to $2.5 million if it failed. Issue 6, the 0.5 percent income tax for Springfield schools, lost by 589 votes, with 6,518 votes against and 5,929 votes in favor. Mr. Geha said he was still trying to calm down and regroup after the levy defeat. “We will have to decide on the cuts we need to make for fall of 2027,” Mr. Geha said. “This is going to mean reduced opportunities for kids and a reduced number of adults in the buildings. There will be job cuts, and all of these things are going to be painful.” Mr. Geha said cuts are coming regardless of whether the school board decides to put a levy on the May ballot. “Even if we pass a levy, then it would not help us now,” he said. “The

Another lawsuit filed over North Toledo chemical leak
Another lawsuit been filed in the aftermath of last month’s airborne chemical leak from MC Tank Transport in North Toledo. The latest case involves eight plaintiffs of record. Molly A. Ebraheim, an attorney representing them, said more are likely to be added as part of an amended complaint. “We are not bringing it as a class action. We are bringing it as a multi-plaintiff claims case,” she said. “Our clients are just choosing to bring their own individual claims.” Ms. Ebraheim is one of three attorneys in the Maumee office of Nurenberg, Paris, Heller & McCarthy Co. who are working on that case. A 19-page complaint they filed in Lucas County Common Pleas Court states that each of their clients “suffered harm different in kind from that suffered by the general public, including displacement costs, lost wages, medical treatment, and property impacts.” The plaintiffs are Larry Sanchez, Kenyada Hooks, Kapreece Sims, Eric Walker, Bryan Smith, Felix Abalos, Michael Sims, and Timothy Myers. All are from Toledo except Michael Sims, who lives in Sacramento, and Mr. Myers, who lives in Eastlake, Ohio. The latter two were traveling through Toledo when the release began on the night of Oct. 20, and were
