    Denton County woman appeals to Texas Supreme Court over possession of frozen embryos

    There is another legal fight surrounding the Texas abortion law. This one involves a Denton couple who disagrees about who gets frozen embryos in a divorce.

    The couple signed a prenuptial agreement that gave the possession of the frozen embryos in the even they split up.

    In their case, the boxes were checked, it was signed off on by both husband and wife that the father would retain those embryos that remained," the husband's attorney Patrick Wright said. "By contract, everybody signed off on it and the judge found it was valid."

    The wife is appealing to the Texas Supreme Court, claiming Texas' new abortion law declares that embryos are human beings -- and she wants possession of them.

    Her attorney could not be reached for comment. The Texas Supreme Court has not yet decided whether it will hear the case.
