Family of Irvo Otieno to address prosecutor’s request to have charges dropped for 5 of 8 people charged in his death

RICHMOND, Va. (WRIC) — Irvo Otieno’s family, along with their attorneys, are set to address a pivotal move on Monday — the request to drop the charges of five out of eight people charged in his death.

8News received an update on a press conference scheduled for 11 a.m. on Monday, May 6 with details of their attendance.

Dinwiddie County Commonwealth’s Attorney Amanda Mann confirmed to 8News that nolle prosequi — or “unwilling to prosecute” — motions were filed on Friday, May 3 for the five deputies charged; Randy Boyer, Dwayne Bramble, Jermaine Branch, Bradley Disse and Tabitha Levere.

On Monday, May 6, the Attorney’s Office announced that those five nolle prosequi motions were granted.

On March 6, 2023, Irvo Otieno was being transferred from Henrico County Regional Jail West to Central State Hospital. Virginia State Police — the agency leading the investigation into Otieno’s death — says as deputies were admitting him as a patient, he became combative during the intake process.

8News was able to obtain security camera video showing the moments leading up to Otieno’s death. Deputies and hospital staff can be seen restraining him for an estimated 12 minutes before he is rendered aid by staff members and EMS responders — after which he was pronounced dead.
