    Defendants failed to overcome statutory presumption of permissive use

    In this wrongful death claim, the defendants disputed coverage, alleging the co-defendant’s son did not have permission to use his father’s vehicle and the statutory presumption was rebutted.

    Plaintiff’s counsel obtained all video interviews of witnesses, defendants’ statements to police during the criminal investigation, and interviewed witnesses and attended all the criminal proceedings.

    Through discovery, plaintiff’s counsel was able to prove that the defendants could not overcome the statutory presumption of permissive use. The case settled for the policy limits of $1 million.
