ALBANY, N.Y. ( NEWS10 ) – Luiggi Canessa’s federal detention hearing wrapped on Thursday. Judge Christian Hummel decided he should remain in detention in Albany County Jail to ensure he returns to court.

His defense tried to argue he was not a flight risk. However, the judge found he was “less than honest” and “disingenuous” because he failed to disclose properties his companies own and found the income he reported to be 500 percent less than what authorities found.

Questions were raised around the accuracy of the affidavit. He told investigators he did not own property. Prosecutors said they found entities he created owned properties in Schenectady and in Pattersonville. They said there was video evidence of transactions made at the Schenectady property.

His defense argued he did not intend to deceive the court and said the miscommunication stemmed from confusion since Canessa had never been arrested before.

Prosecutors said he significantly underreported his income. They estimate his monthly income was north of $15,000. He reported it was only $3,000.

$21,000 in cash was found in a safe at Shenanigan’s and $20,0000 in cash was found in one of Canessa’s properties. In the affidavit he only claimed to have $10,000 in cash. The defense said his monthly income was fluid because it is a cash business.

In addition to that, prosecutors cited significant amounts transferred to him via CashApp and Venmo. The defense said those amounts were reimbursements, not income.

The judge said Canessa has been “less than candid” and found he is a danger to the community and a flight risk.

The FBI has been investigating suspected crimes at Shenanigan’s since late last year.

Last week NEWS10 heard from neighbors and former employees that there’s been a lot of activity at Shenanigan’s and said it’s about time authorities did something about it.
