Bond reduced for Mount Vernon man charged with killing 3-year old
A Mount Vernon man accused of killing a 3-year old boy while babysitting him earlier this year had his bond reduced during a motions hearing on Wednesday. 35-year old Shawn DeLancey has pleaded not guilty by reason of insanity to the charge of second-degree murder. DeLancey’s bond had been $500,000 cash only. His attorney, Chris Nipe, argued that it was a punitive bond and asked for Judge Giles to lower it to a more reasonable amount such as $25,000 or $50,000 and submitted a release plan which included details about where DeLancey would live and work. Davison County State’s Attorney Jim Miskimins argued against lowering the bond, saying DeLancey is a flight risk and a threat to himself. Davison County Jail Administrator Grant Lanning testified that DeLancey had been on the jail’s highest level of suicide protocol until last week. Judge Giles agreed to lower the bond to $100,000 cash only. Also at Wednesday’s hearing, Judge Giles rejected the defense’s request to allow testimony from a false confessions expert. He rejected a request for deadlines to be set for experts’ reports and ruled that all experts testifying would have reciprocal disclosure. No trial date has yet been set for DeLancey, who faces a maximum sentence of life in prison.
