    Indiana judge rules 'tacos are sandwiches'

    It’s official! Tacos are sandwiches!

    At least that’s the ruling by an Indiana judge in a case over the legality of a taco restaurant’s presence in a Fort Wayne strip mall.

    The crux of the argument stemmed from a “written commitment” accepted by Famous Taco owner Martin Quintana, who was looking to put one of his franchises in the mall. That written commitment, issued to a local neighborhood association, said that restaurants in the mall were prohibited from selling alcohol, having outdoor seating, and could only sell “made-to-order or subway style sandwiches.”

    Court documents showed that the reasoning for the agreement was to keep national fast-food franchises like burger and chicken joints out of the mall.

    “The Court agrees with Quintana that tacos and burritos are Mexican-style sandwiches, and the original Written Commitment does not restrict potential restaurants to only American cuisine-style sandwiches,” Judge Craig Bobay of the Allen Superior Court wrote in his opinion Monday.

    “The original Written Commitment would also permit a restaurant that serves made-to-order Greek gyros, Indian naan wraps, or Vietnamese Banh mi if these restaurants complied with the other enumerated conditions,” the opinion continued. Bobay did leave his decision open to appeal.

    Now that that’s settled, can we get a ruling on whether cereal in milk constitutes soup?
