    Dunkirk man accused of providing fentanyl that led to fatal overdose

    PORTLAND, Ind. — A Dunkirk man has been accused of providing the fentanyl that led to an acquaintance's overdose death.

    Cody Alan Brenner, 33, is charged in Jay Circuit Court with dealing in a controlled substance resulting in death, a Level 1 felony carrying a maximum 40-year sentence.

    According to an affidavit, the charge stems from the Sept. 10 death of a 26-year-old Dunkirk resident.

    In an affidavit, a Jay County sheriff's deputy alleged Brenner dealt what was believed to be a mixture of fentanyl and heroin to a juvenile, who in turn provided the substance to the man who later overdosed.

    Brenner in April received a five-year sentence — three years of incarceration followed by two years on probation — after pleading guilty to dealing in a narcotic drug in another Jay Circuit Court case.

    In May 2022, he was convicted of possession of meth.

    Aaron D. Baker, 51, had pleaded guilty to dealing in meth. maintaining a common nuisance,

    In recent days, Jay Circuit Court Judge Brian Hutchison imposed a 20-year sentence for the dealing conviction, and added eight years as a penalty for Baker's status as a habitual offender.

    A plea agreement called for dismissal of four other charges — dealing in a narcotic drug, possession of marijuana and possession of paraphernalia.

    According to court documents, a witness told Jay County sheriff's deputies he routinely bought heroin from Baker and also "worked out trades" for the drug, which he then sold to others, including a juvenile.

    According to court records, the former Muncie resident had earlier been convicted of dealing in a controlled substance, possession of a controlled substance and driving while intoxicated.
