Movie star Jason Momoa and rising homegrown filmmaker John Swab have been clocked in and getting to work in downtown Oklahoma City this week. Restaurateur Brent Swadley is asking a judge to let him go home on probation. He also doesn't want to pay any restitution, and more than 40 supporters wrote character letters praising him. A number described him as a man of integrity. Prosecutors want the judge to send him to prison for 10 years for his fraud crimes. They also are asking the judge to order him to pay almost $10 million in restitution to the state and $75,000 in fines. Oklahoma County District Judge Cindy Truong has set aside two days − Oct. 21 and 22 − to decide restitution and punishment in the highly publicized case. The sentencing is set to begin at 9 a.m. Wednesday. However, a new issue could result in another delay. Swadley on Oct. 19 sued State Auditor Cindy Byrd for a forensic audit report over his contract with the state. "Defendant Byrd cannot use her public office to impact criminal cases, yet simultaneously avoid the transparency requirements of the Open Records Act," his attorneys complained. The attorney general's office has said no written report exists. "Our office remains focused on securing justice in this case, and we look forward to his sentencing hearing," the
