In the latest edition of " Point Of Order " on The Rashad Richey Morning Show , Attorney Erica Wilson shared insights on the implications of House Bill 1017 on squatters in Georgia. The conversation delved into the significant changes brought about by this new bill, aimed at providing stronger protections for homeowners facing issues with individuals unlawfully occupying their properties.

The interview commenced with a discussion on the previous challenges faced by homeowners dealing with squatters who asserted a sovereign right to occupy unoccupied homes. Attorney Wilson highlighted the arduous and lengthy eviction process homeowners often faced, with law enforcement directing them to civil court, resulting in prolonged legal battles.

However, House Bill 1017 revolutionizes the process. Attorney Wilson emphasized that the bill shifts the burden of proof onto squatters, requiring them to produce a valid lease within three days of receiving a notice. Failure to comply can lead to swift eviction proceedings now handled in magistrate court for a more expedited process.

One of the most substantial aspects of the bill is the criminalization of squatting, holding individuals attempting to unlawfully occupy properties legally accountable. Attorney Wilson explained how this change streamlines the eviction process, reducing potential months of legal battles to mere weeks.

The interview also addressed the potential conflicts with sovereign citizens' beliefs in their squatting rights. Attorney Wilson noted that such arguments historically have not stood in court, emphasizing the importance for homeowners to seek legal counsel and take proactive steps to protect their properties, such as hiring property management companies.
