BELMONT COUNTY, Ohio (WTRF) — There’s a new development in the civil suit against Austin Master Services, the company allegedly storing radioactive and fracking waste beyond the allowed limit in Martins Ferry.

Ohio Attorney General David Yost has now added two more defendants to the suit–parent company American Environmental Partners and owner Brad Domitrovitsch.

The suit claims the company has added tons of waste, far beyond its permitted capacity, and has let it flow out of its storage containers.

The North First Street facility is 500 feet from the Ohio River and 1,000 feet from Martins Ferry’s drinking water field.

The suit is asking that Austin Master Services suspend operations, stop accepting new waste, and remove all liquids from the floor and from secondary containment areas, including rail cars, frac tanks, and roll-off containers.

A hearing is set in Belmont County Common Pleas Court for mid-May before Judge John Vavra.
