    Harvey Weinstein set to return to Manhattan court Wednesday following overturned rape conviction: DA

    NEW YORK (1010 WINS/WCBS 880) – Harvey Weinstein will be in Manhattan Supreme Court next Wednesday after New York's highest court overturned his 2020 rape conviction, according to the Manhattan District Attorney's Office.

    Manhattan District Attorney Alvin Bragg initially stated that he intends to retry Weinstein on Wednesday, and at least one of his accusers said through her lawyer that she would testify again.

    “We will do everything in our power to retry this case, and remain steadfast in our commitment to survivors of sexual assault,” a district attorney's office spokesperson reconfirmed.

    He is now scheduled to appear before Judge Curtis Farber on Wednesday, May 1, at 2:15 p.m,

    “At the Manhattan D.A.’s Office, our Special Victims Division fights each and every day to center survivors, uplift their voices, and seek justice for these horrific crimes,” the spokesperson said. “Our mission is to center survivors’ experiences and wellbeing in every decision we make, which we will do as we approach the next steps in this case.”

    New York’s highest court on Thursday threw out Harvey Weinstein ’s 2020 rape conviction with a ruling that shocked and disappointed women who celebrated historic gains during the #MeToo era and left those who testified in the case bracing for a retrial against the ex-movie mogul.

    The court found the trial judge unfairly allowed testimony against Weinstein based on allegations that weren’t part of the case.

    Weinstein, 72, will remain in prison because he was convicted in Los Angeles in 2022 of another rape. But the New York ruling reopens a painful chapter in America’s reckoning with sexual misconduct by powerful figures — an era that began in 2017 with a flood of allegations against Weinstein.

    #MeToo advocates noted that Thursday’s ruling was based on legal technicalities and not an exoneration of Weinstein’s behavior, saying the original trial irrevocably moved the cultural needle on attitudes about sexual assault.
