HONOLULU (KHON2) — The man found guilty of attempted murder in connection with a stabbing at Kahala Beach may get a new trial.

A judge overturned the conviction due to misconduct by prosecutor.

In July 2020 Erik Willis received a life sentence with the possibility of parole for stabbing a 17-year-old girl who was sunbathing.

However, according to the appeals court ruling, the state provided no forensic evidence, failed to produce a weapon and during closing arguments.

The prosecuting Deputy Attorney introduced evidence that was never mentioned in trial.

Willis’ attorney — Eric Seitz — said Willis remains in custody pending a court hearing.

The prosecutors office said it is reviewing the appeals court’s opinion, and will either ask the state supreme court to uphold the conviction or re-try the case.
