ROCHESTER, N.Y. (WROC) — A convicted felon out of Batavia was arrested by the Wyoming County Sheriff’s Office after deputies said he was driving while intoxicated with unregistered firearms in the vehicle.

According to the sheriff’s office, deputies patrolling in the Town of Java clocked a vehicle going 75 in a 55 and crossing the center lime on State Route 77. When they pulled the car over, deputies say the driver and passenger appeared to switch seats as they approached the vehicle.

Police said the original driver, 22-year-old Christian DeLuna, failed a field sobriety test. Before starting that test, deputies found a loaded ghost gun in his waistband.

DeLuna’s license had been revoked due to a prior alcohol related offense. He was also on probation for a 2022 attempted burglary conviction, preventing him from possessing firearms.

Police said a semi-automatic AR style rifle was also found in the backseat of the vehicle.

DeLuna is facing a lengthy list of charges, including Criminal Possession of a Weapon and Driving While Intoxicated.
