Police: Suspect involved in Amber Alert should have known child was in car

DENVER ( KDVR ) — After a vehicle theft led to an Amber Alert on Sunday night , police claim that the suspect, Kirk Abercrombie, should have known that there was a child in the car, according to the affidavit obtained by FOX31.

On Sunday night, Abercrombie allegedly stole a vehicle from a 7-Eleven in Aurora with a 6-year-old girl inside and drove about an hour and a half before police found the child and took Abercrombie into custody.

Police said the mother had gone into the convenience store and left the motor running before the Jeep was stolen.

According to the affidavit, when Abercrombie was taken into custody, he said he didn’t know the child was in the car.

However, Aurora police found it “implausible” that Abercrombie didn’t notice the child in the back as he drove around 72 miles away from the 7-Eleven.

“The child was noted to be verbal and not have any defect or disabilities that would prevent (redacted) from being noticed in the back seat,” the affidavit says.

The affidavit also noted that Abercrombie did not attempt to return the child or take the child out of the vehicle after he allegedly noticed the 6-year-old inside.

According to the affidavit, Abercrombie is facing the following charges:

  • Second-degree kidnapping
  • Motor vehicle theft

Abercrombie is currently being held on a $50,000 bond.
