Court filing addresses “just compensation”
The drug store chain CVS has placed South Carolina DOT on notice that it is challenging what the state agency deems just compensation for taking of land in the vicinity of the Seneca CVS. And the Charleston law firm representing CVS recently filed in the Oconee Common Pleas Court notice that it seeks a jury trial on the issue of just compensation. The issue has ramifications for DOT’s plans to rework the traffic light East End Seneca intersection for the 123 ByPass at SC 130. For real property DOT wishes to acquire for the intersection project, the state agency has offered around $40 thousand dollars for two sets of rights-of-way. SCDOT is vested with the power of eminent domain, but CVS wants a trial.
