Judge in Idaho murder suspect's trial says defense can continue to survey potential jurors

MOSCOW, Idaho - The legal team for the man accused of killing four University of Idaho students can now resume surveying potential jurors.

According to new court documents, Judge John Judge ruled the defense can now continue conducting surveys. Judge's decision was made a few weeks after placing a temporary pause on them while he considered whether this violated the court's non-dissemination order.

In the judge's most recent ruling, he wrote the defense could continue the process if Kohberger's attorneys believe it is more beneficial than harmful - despite questions in the survey containing "prejudicial or misinformation".

The judge also ruled the Court does not have enough evidence to second-guess the strategic decision by the defense.
