A Maple Grove man has evaded a criminal sexual conduct conviction, but will register as a predatory offender per orders April 9 from Hennepin County District court.

Julio Ceballos, 26, was sentenced to more than 3 years in jail for first-degree burglary, a felony. He was sentenced to 41 months in the Minnesota Correctional Facility in St. Cloud. He will have a credit of 93 days for time served.

As part of the conditions of his sentencing, Ceballos must give a DNA sample when directed. He cannot possess firearms, ammunition or explosives. He also has to register as a predatory offender.

Ceballos previously made a plea deal on March 18 in the case against him.

In January, he was charged in Hennepin County court with one count of first-degree burglary and one count of third-degree criminal sexual conduct. During his plea deal, Ceballos plead guilty to the count of burglary and asked that the count of criminal sexual conduct be dismissed.

According to the complaint, the victim (known to Ceballos) got off from work around and went to her Maple Grove home. The complaint goes on to state that the victim woke up to find Ceballos on top of her having intercourse without her consent.

The complaint states Ceballos entered the victim’s home without consent by using knowledge overheard on how to enter the home.
