Phan, for his part, alleges that Axon cameras collect his vehicle and location information as he travels around Palm Desert. Axon introduced mobile ALPR cameras in 2021 and began deploying fixed cameras in 2025, according to the seed facts. The complaint alleges Axon aggregates that plate data with information from other sources through its Fusus and Axon Evidence platforms, letting law enforcement agencies search vehicle records alongside other surveillance information. The complaint further alleges that aggregated records allow authorized users to reconstruct motorists' movements and build detailed profiles of their daily activities.</p><h2>What the Lawsuit Seeks</h2><p>The proposed class, per the seed facts, would cover California drivers whose vehicle data was captured by an ALPR and processed or stored through Axon's systems since 2023. Plaintiffs are seeking more than $5 million in damages, along with a court order preventing Axon from continuing what they call unlawful practices. They also warn that incorrect information could place vehicles on law-enforcement hotlists, potentially leading to erroneous identification and detention.</p><p>The complaint leans on California's Automated License Plate Recognition Privacy Act, enacted in 2015, which the seed facts say requires ALPR operators to prominently publish a policy explaining how information is collected, maintained, accessed and shared. The lawsuit alleges Axon failed to publish a privacy and usage policy meeting that standard, and argues that whatever technical safeguards Axon has built do not substitute for its legal obligation to publish a compliant policy.</p><h2>Axon's Own Account of Its Safeguards</h2><p>Axon's product materials describe a different picture of how the system is designed to work. The company's ALPR Sharing guide states that a donor agency invites a specific partner to receive access, and there is no way for another agency to request or pull that data on its own, according to Axon. The same guide says shared data never leaves the donor agency's tenant, and that every cross-agency search must declare an offense category, with data excluded if the donor agency has not permitted that category.</p><p>Axon's Fleet 3 FAQ separately states that plate reads and hits are encrypted, stored on the vehicle hub, and securely uploaded to CJIS-certified cloud storage, and that the system uses artificial intelligence to process ALPR reads and establish attributes including vehicle color, make and type. Those materials describe Axon's own product design; they do not address the specific allegations raised in the California lawsuit.</p><h2>A Broader Fight Over License Plate Cameras</h2><p>The Axon case lands amid wider upheaval over automated license plate readers across California and beyond. In Los Angeles, a pilot program to attach hundreds of Axon readers to streetlights cleared the City Council and was expected to launch soon, according to the Los Angeles Times. That move came after the LAPD declined to renew its agreement with rival vendor Flock Safety amid concerns that license-plate data could be used for immigration enforcement, the paper reported.</p><p>More than two dozen cities and counties nationwide, including Santa Clara County, Santa Cruz and Los Altos Hills, have cut contracts with or distanced themselves from Flock after reports that federal agencies could tap into local camera networks, according to KQED. A crowdsourced database cited by the Times put the number of cities that had deactivated Flock cameras, rejected new deals or canceled existing ones at roughly 100.</p><p>Flock itself has faced legal challenges on separate fronts. A Santa Clara County judge dismissed a lawsuit challenging San José's network of license plate readers, a case filed in November 2025 by the ACLU of Northern California and the Electronic Frontier Foundation on behalf of CAIR-CA and SIREN, per KQED's reporting. The Institute for Justice, which brought a related federal suit over the same camera network, has described the system's camera count as both 475 and 474 in separate statements — a discrepancy the available record does not resolve.</p><p>In Georgia, a separate federal class action filed Aug. 25 accuses Flock Group Inc. of building what the complaint calls an unchecked, pervasive surveillance grid, according to Atlanta News First. That proposed nationwide class covers anyone in the United States whose plate data Flock has collected since January 1, 2024. Flock has said it is shortening its default data-retention period from 30 days to seven days, the station reported.</p><p>The Axon lawsuit does not name Flock as a party, and the two companies' legal fights remain separate matters. But together, the cases reflect a mounting legal reckoning over how license plate recognition technology is deployed, disclosed and governed across California communities and the country, with Mun and Phan's complaint now adding Axon directly to that fight.</p></div></body>
