Giant Food is applying to renew its class “B” full-service liquor license, but commissioners are hesitant to support its application because of repeated violations. According to Eckenwiler, the current settlement agreement bars delivery vehicles from occupying the area between the curb and the building line except when traveling to or from the loading dock. “Apparently the message just is not getting through,” he said. “I don’t know if it’s a problem with the lawyers or a problem with the rotating cast of managers, but to me it’s unacceptable.” Adelstein questioned if Giant Food had been notified of these violations. While Eckenwiler recalled notifying the store of a “particularly egregious” instance in which pedestrians had to walk in the street because delivery vehicles blocked the entire area for an extended time, he also emphasized that the store has a “lengthy history” of these types of infractions. If the commission enters into another settlement agreement with Giant Food, Adelstein asked whether it would suggest harsher language to enforce its terms. Given that Giant Food has an attorney and is the “offending party,” Eckenwiler said he will leave the responsibility of proposing a solution to them. “I’m going to put this on them because I honestly don’t know quite what else we can do.”The commission voted to protest the store’s license renewal application. <h2>Other Matters</h2>The Commission voted to: • support the District Department of Transportation’s (DDOT) Notice of Intent (NOI) to install a contra-flow bike lane along 400 to 700 blocks of 7th Street NE;• support the Board of Zoning Adjustment (BZA) application for a special exception from lot occupancy requirements to construct a two-story accessory building at the rear of an existing three-story flat at 311 F St. NE;• send a letter to the Office of Planning (OP) concerning infrastructure improvements and encouragement to developers to install or subsidize infrastructure, such as sewer lines under alleys, that promotes construction of additional housing;• support the renewal of a class B full service grocery license at Whole Foods at 600 H St. NE.The commission met on Oct. 14. Commissioners Jeremiah Foxwell (6C01), Karen Wirt (6C02, chair), Jay Adelstein (6C03, treasurer), Mark Eckenwiler (6C04, vice chair), Daniela McInerney (6C05, secretary) and Tony Goodman (6C07) were in attendance. Single Member District 6C06 remains vacant. The commission will next meet on Nov. 12 at 7 p.m. via WebEx.
