It created three lots that the city now has, where the Law and Justice Center and Fire Hall are, along with property adjacent to 9th Ave. NW. It also created two large lots along 4th St. NW., installing utilities, however those lots have remained vacant.Phase two initially had plans to create a series of smaller lots, but as the oil boom died down, so did the demand for commercial property in that area, leaving the land to sit idle for about a decade.With the recent uptick of activity in Sidney, the hope is that someone may be interested in developing the lots, and so Phase 2 was back on the table.One challenge has been that a portion of the oddly shaped property had agricultural restrictions, and in order to lift those restrictions, it needed to become approved as a subdivision in order to make the property marketable under B2 commercial zoning. B2 commercial zoning allows for a lot of flexibility for both commercial and residential uses.Under city subdivision regulation, the property qualified for expedited review, but city policy states water and sewer must be extended to the outlying edges of the property. The two lots are served with water and sewer from 4th St. NW, however the ‘L’ shaped lot does not have services at its farthest point, which extends to 14th Ave. NW.Being as there is no benefit in requiring the extension, the motion to grant the variance to the requirement for the sewer extension on 14th Ave. NW passed. Should the oddly shaped lot ever be subdivided, owners would then be required to extend the sewer.The owners now have three years to prepare a final plat and present it to City Council for approval.“I haven’t seen a lot of new subdivision action since the boom died down. I think new lots available are a win for the Sidney community and economy,” commented Forrest Sanderson, Sidney City Planner.</div>
