Abigail Dollins/Statesman Journal via Reuters Connect

Oregonians packed a Capitol hearing room to capacity Monday afternoon to testify on a bill that would alter a controversial gun control ballot measure that requires Oregonians to apply for and obtain a permit before purchasing a gun and outlaws large-capacity magazines that hold more than 10 rounds. Most of the thousands of people who have submitted written testimony on House Bill 3075 are opposed.Ballot Measure 114 was narrowly approved in 2022. The measure has not been implemented amid challenges in state and federal courts. Oregon gun owners and Harney County residents Cliff Asmussen and Joseph Arnold filed a lawsuit in Harney County Circuit Court and were granted an injunction shortly after the vote.
What does Oregon House Bill 3075 do?
As the legal battle continues, lawmakers are weighing changes including increasing the length of time a "permit agent" has to issue or deny permits required under Measure 114 after completing a gun safety class and a federal background check, increasing fees to apply for a permit or renew one, and adding alternatives to a firearms training course or class that would meet the requirement of a firearm safety course for the permit.HB 3075, if passed, would also exempt from public records information obtained during the application process. The bill specifically increases permit fees from $65 to $150 per applicant and limits the amount paid to the Oregon State Police for conducting the state and federal criminal background check to $48. Fees to renew a permit are increased from $50 to $110.HB 3075 would also extend the time a permit agent has to issue a permit to an applicant or mail denial reasons from 30 to 60 days. The bill also clarifies that manufacturers and dealers of large-capacity magazines have a 180-day grace period from prosecution after the injunction is overturned or vacated.Any further challenge of the law would have to be filed in the Marion County Circuit Court under HB 3075.
Testimony in support, opposition of Oregon bill modifying Measure 114
"We're very eager to have it (Measure 114) put in place," said Liz McKenna, with the grassroots organization that sponsored Measure 114, Lift Every Voice Oregon. "It's time to see what it can do."State Sen. Lisa Reynolds, D-Beaverton, said HB 3075 came together through a workgroup that included the Oregon State Police, Oregon State Sheriffs' Association and the Oregon Department of Justice. McKenna said it had been a collaborative effort aimed at meeting voter intent and smooth and easier implementation of Measure 114."The Legislature needs to act this session," said Amie Wexler, lead for Oregon’s Moms Demand Action, a gun violence prevention organization. "The will of the voters has been delayed long enough."Wexler said she has been involved in the movement since 2015 and has testified in front of the committee numerous times. She recalled the school shooting in Uvalde, Texas, and shooting at the Bend Safeway in 2022 that she said fueled support for Measure 114. Oregonians spoke at the ballot box, she said."They want this policy to be a reality," Wexler added. "Please do what is right and make this the first of many gun violence prevention measures that you pass this session."Other speakers in support of the bill included parents and family members of people who had died by suicide with a firearm or experienced gun violence.Gun rights advocates also spoke at the hearing, urging lawmakers to reconsider."This bill is not what the voters just barely approved in 2022 with Ballot Measure 114," said Aoibheann Cline, Oregon NRA director. "The bill demonstrates a clear disdain for the right to keep and bear arms."Taren Darr, a member of Women for Gun Rights, said the permitting process established by Measure 114 and changes proposed in HB 3075 were costly and time-consuming and a luxury that women like her might not be able to afford. Women need access to firearms, not barriers, she added.State Rep. Alek Skarlatos, R-Roseburg, also testified in opposition to the bill, saying every firearm he owns has a 30-round magazine and said magazines holding more than 10 rounds are "standard magazines."Skarlatos served in the Army National Guard and made national headlines after stopping a gunman on a train en route to Paris."I survived a terrorist attack in a gun-free continent. The terrorist got a fully automatic AK 47 and a handgun," he said. "If you're going to commit mass murder, you're not going to worry about committing a Class A misdemeanor along the way."
What is the status of Oregon Ballot Measure 114?
The Oregon Court of Appeals overturned the 2023 ruling from the Harney County Circuit Court last week and determined "all of Measure 114 is facially constitutional."Robert Koch, senior assistant attorney general representing the state and defending the measure in court, told lawmakers Monday that when the state can begin implementing Measure 114 "depends."Challengers of Measure 114 have said they will petition for further review from the Oregon Supreme Court. The next steps depend on the Oregon Supreme Court, Koch said. If the court denies the request, then appellate procedural rules give 28 days to seek reconsideration of that denial. That entire process from petition to denial typically takes three to six months, Koch said. But if the Supreme Court agrees to take the case, a fresh round of briefing, oral argument and waiting for a decision would begin. "And that process can take one to two years," Koch explained.Dianne Lugo covers the Oregon Legislature and equity issues.
