A Baldwin County gun range owner says he's now forced to close after a judge ruled customers can't drive on the privately owned road to access the range. The owner of PigFarm Gun Range says that effectively leaves them land locked and out of options.
"It's horrible, but it also doesn't just affect me. I have trainers that come out, and they use this place to also feed their families. We have law enforcement that uses it," said owner Shane Bailey.
Bailey has operated the range that's north of 1-10 off County Road 87 for years. He leases the land, and the land owner has been locked in a legal battle over the dirt road that's been used to access the site. The owner of the dirt road and surrounding land is Belle Fountain Land Company, and according to records and social media posts, developers are building a motorsports park. An attorney for Belle Fountain Land Company told NBC 15 News in September the gun range is not legally considered land locked because there is access on the north side. But Styx River cuts through the property, which Bailey argues makes access impractical.
"There's no other way to get in it except to cross the river. And that's not access because you cannot bring anything like heavy machinery to service this land or anything else across that river. And you can call ADEM and find out yourself that you cannot buy a bridge or build a bridge across that river. It is impossible," said Bailey.
Down the dirt road another land owner, Darlene Clark is in a similar situation. She also says she's land locked and can't use the privately owned road to get to her land.
"To pay for this property, I was the one that worked overtime. I'm the one that sends in the money every year to pay the taxes on it. And we never had an issue," said Clark.
Clark is currently exploring her legal options. Bailey says he's trying to figure out what's next as well. For now, he's shut down, but he says many customers have been reaching out offering support.
"There really is nothing that they can do other than park on the north side and cross a 40 yard river," said Bailey.
Bailey says he has 30 days of access to the road to remove items from the site, and after that it would be considered trespassing if he goes on the road.
