Nick Kyrgios Not Convicted of 2021 Assault Despite Entering Guilty Plea

Nick Kyrgios pleaded guilty Friday to assaulting former girlfriend Chiara Passari in January 2021, but a magistrate in Australia declined to convict him.

Per the Associated Press, magistrate Jane Campbell said the offense was not premeditated and was at the low end of severity for common assault.

"I respect today's ruling and am grateful to the court for dismissing the charges without conviction," Kyrgios said after the decision. "I was not in a good place when this took place and I reacted to a difficult situation in a way I deeply regret. I know it wasn't OK and I'm sincerely sorry for the hurt I caused."

Per the AP, Kyrgios pushed Passari to the ground as she was stood in front of the open door of an Uber while he was trying to close it and leave after an argument between the two.

Passari later reported the assault after the end of her relationship with Kyrgios, who received a court summons in July after being charged with common assault.

The AP noted Sam Borenstein, Kyrgios' psychologist, told the court during Friday's hearing that Kyrgios has suffered from "severe depression, suicidal ideation and insomnia" in the past and his mental health has led to impulsive and reckless behavior.

According to agreed-upon facts read in court cited in the AP report, Kyrgios "pushed Passari's shoulders backward with open palms" that caused her to fall to the ground and graze her knee on the pavement.

Kyrgios has spoken publicly about his mental-health problems. He told Craig Gabriel of Wide World of Sports last May he's been at the "point of self-harm" and used to abuse "alcohol a lot, drugs and that spiraled out of control."

The 27-year-old had to withdraw from this year's Australian Open because of a knee injury that required surgery. Borenstein said Kyrgios' mental health has "improved significantly," but the injury has resulted in moderate symptoms of depression.
