The Middlesex County Prosecutor’s Office says that charges have been filed against an 81-year-old man in the death of a 91-year-old patient at the AristaCare at Cedar Oaks rehabilitation facility in South Plainfield.

The prosecutor’s office says that police officers were called to the facility on Jan. 16 to help with a combative patient. Authorities say that the officers arrived to find 81-year-old Angel Bermontiz restrained in his bed. Staff at the facility told officers that he had assaulted 91-year-old Clara Sutkowski.

Authorities say that Bermontiz slapped Sutkowski during the incident, causing her to fall and hit her head on the floor. She was taken to Robert Wood Johnson University Hospital but died from her injuries several days later.

Bermontiz was charged on Friday with one count of second-degree reckless manslaughter.

Members of Sutkowski’s family previously told News 12 New Jersey that they have filed complaints against AristaCare.

A Kane In Your Corner investigation found that in the past five years, data from the Center for Medicare and Medicaid Services shows AristaCare's South Plainfield facility has paid the federal government nearly a quarter of a million dollars in fines. That is the sixth-most of any nursing home in New Jersey.

Kane In Your Corner also looked at the inspection reports over those five years and found only 11 deficiencies - none of which were deemed serious. The facility also has a four-star rating, indicating the federal government believes the facility is above average overall.
