Pelosi won’t speculate whether Trump could be charged after Biden document scandal

Rep. Nancy Pelosi (D-CA) refused to speculate whether former President Donald Trump could be charged with a crime given the mishandling of classified documents from President Joe Biden‘s vice presidency.

CNN host Chris Wallace asked Pelosi whether it was impossible for Trump to be charged for the top secret documents discovered at his Mar-a-Lago resort, because classified documents were discovered at Biden’s home office, garage, and at the Penn Biden Center for Diplomacy and Global Engagement.

“Even if the facts were to bear out that Trump committed a crime and should be charged, isn’t it, as a practical matter, impossible [to charge him] given the fact that Biden had documents in his office, and had documents in his home?” Wallace asked during the latest episode of his show “Who’s Talking to Chris Wallace?”

Pelosi responded that there was no way to know whether Trump could or should be charged with a crime, even with the new Biden discovery, until a special prosecutor looks at the case.

“It depends,” Pelosi said. “The attorney general asked someone to review to see if a special prosecutor was recommended. He said yes, there was a special prosecutor for Joe Biden, even though the cases are quite different. We don’t know until the special prosecutor does all of the investigation. When you say is it harder? I don’t know. I don’t know. It just depends on what comes out of the investigations.”

Democrats have claimed that there are major differences in the cases, including the number of documents obtained in each discovery, which was hundreds in the case of Trump and around two dozen for Biden. Other key differences are how the documents were discovered and obtained, and the responses to the discoveries. Biden said he has cooperated with the Department of Justice since notifying them of the documents in November.

“President Biden has said his lawyers are finding these and bringing them out,” Pelosi told Wallace. “President Trump was obstructing access to them. So I think you look at volume, you look at procedure, and then you have to see what the nature of the document, but we don’t know what the nature is.”

Attorney General Merrick Garland announced the appointment of special counsel Robert Hur to spearhead the DOJ’s investigation into the classified document scandal last week, and the House of Representatives has opened inquiries into the documents.

The material is believed to stem from 2013 to 2016 and reportedly features intelligence on Iran, Ukraine, and the United Kingdom. Presidents and vice presidents are expected to relinquish those types of documents at the culmination of an administration.
