Quinceañera victim's claim was denied by other party's insurance, now what?

Crystal Ballesteros, a Fresno mom is at a loss of words after finding out the insurance company from the other party of the lawsuit she won, denied her claim.

She says she received a letter from Farmers Insurance Group saying in-part:

As a follow up to our previous telephone conversations, please be advised that our coverage investigation has determined that the commercial general liability police issued to Lina Gil dba Sofia’s Creaciones does not apply to restitution awarded to you by the small claims court...our decision regarding the question of whether coverage is afforded by the policy is completely separate and independent from the question of whether our insured has any legal liability for the claims presented, and therefore is neither an express nor implied admission of any such liability on the part of our insured.

The last time FOX26 News spoke with Ballesteros, she had found out Lina Gil nor the company Sofia's Creaciones had filed a claim for her payout, even after the owner told Ballesteros the insurance was taking care of it.

When Ballesteros reached out to the other party's insurance company, it had no idea of the court settlement.

She says the insurance company told her that Gil had filed a theft claim.

Ballesteros says she doesn't know what to do next but she's not giving up.

"I’m going to go online, to fill some court documents out, to take her back to court. I don't even know if it’s possible. I’m going to see if I can now increase my lawsuit," she said.
