Former Hamilton County DA Neal Pinkston is filing a motion requesting that the current DA Coty Wamp allow two evicted Budgetel residents to go and get their personal belongings from the closed down motel.
The motion is requesting that Ruby Williamson and her fiancé Emmanuel Wells be able to remove their personal items from room 4216.
Because they are Williamson and Well's personal items, the motion says they are unrelated to the petition for nuisance abatement.
The motion is also requesting that East Ridge Police and the Hamilton County DA document via video, audio, and documents, the removal of the personal items.
The motion says documenting this will preserve the court's temporary order until a final hearing can be held on behalf of former Budgetel residents.
The motion asks for this to happen on December 5th before the hearing.
Another motion to enter says Williamson and Wells rented room 1108 on July 9th for a week at the Budgetel.
The motion says they were then transferred to room 4216, which they rented until November 19th when they were evicted.
The motion says the two never missed rent payment and would normally rent occupancy every two weeks.
On November 12th, the motion says Williamson and Wells paid $277 to the Budgetel for two weeks of rent. The next payment would've been on November 26th.
Williamson is in her third trimester and during the several months that they rented a room, the motion says the couple gathered many items for their unborn child.
It also says there were ultrasound photos inside the room and that the other personal items such as the couple's clothes and tools were inside as well.
The motion says since their hasty eviction, the couple has had to find a new residence and never received the rent back that they paid to the Budgetel.
