Pottstown man sentenced for domestic dispute involving gun

NORRISTOWN — A Pottstown man will be under court supervision for several years for threatening his ex-girlfriend with a handgun and endangering their child who was present during the domestic disturbance.

Anthony Dunn, 32, of the unit block of East Third Street, was sentenced in Montgomery County Court to 9 to 23 months in the county jail after he pleaded guilty to charges of aggravated assault with a deadly weapon and endangering the welfare of a child in connection with the Feb. 17, 2022, incident inside the East Third Street residence.

Judge Virgil B. Walker, who accepted a plea agreement, also ordered Dunn to complete three years’ probation consecutive to parole, meaning Dunn will be under court supervision for about five years.

Dunn will receive credit for the time he’s been in jail since Feb. 17 while awaiting court action.

Dunn also must complete a domestic violence counseling program and parenting classes as conditions of the sentence. The judge ordered Dunn to have “no offensive contact” with his former girlfriend.

The investigation began at 9:21 a.m. Feb. 17, when the victim contacted Pottstown police to report that she and Dunn, her ex-boyfriend, got into an argument about taxes in the Third Street apartment that they still shared, according to the criminal complaint filed by Pottstown Police Officer Zachary Robinson.

“The victim advised the defendant was upset that he would not be receiving income tax money this year and told the victim he was going to rob her when she got her return,” Robinson alleged, adding the woman claimed Dunn retrieved a Glock 9mm handgun from a safe in the residence. “The victim advised the defendant ‘cocked’ the firearm and pointed it at her.”

While pointing the gun at the woman Dunn stated to her, “I’m going to kill you,” according to the arrest affidavit.

“The victim stated the defendant pointed the firearm at her for a few seconds before lowering it to his side. The victim stated the defendant was shaking the firearm by his side and yelled at her to leave the residence,” Robinson wrote in the criminal complaint, adding the woman left and went directly to the Pottstown Police Department.

“The victim advised she feared for her safety and felt the defendant was going to shoot and kill her,” Robinson added.

Court documents indicate the couple’s 2-year-old child also was present during the domestic dispute.

When police went to the apartment and made contact with Dunn he refused to exit the residence, court documents indicate.

“The defendant was given lawful orders to exit the apartment with his hands in the air. The defendant continued to refuse and his two-year-old could be heard yelling inside the apartment,” Robinson alleged. “Officers made entry into the apartment and the defendant attempted to jump out of a bedroom window.”

Dunn then locked himself in a bathroom and left the child between officers and the bathroom, according to court documents.

Dunn was taken into custody a short time later without further incident.

During a search of the apartment, police found a Glock 9mm firearm on top of a safe and it had 15 hollow point rounds in the magazine and one round loaded in the chamber, police said.

Other charges of simple assault, terroristic threats, recklessly endangering other persons, unlawful possession of a firearm and harassment were dismissed against Dunn as part of the plea agreement.

Assistant District Attorney Robert Joseph Waeltz Jr. handled the case. Defense lawyer Keith Andrew Harbison represented Dunn.
