The shooter, Nicholas Lucas was Tate's neighbor. He originally told investigators, he was shooting for target practice and the bullet ricocheted and hit Tate. Days later, forensic evidence showed that the bullet did not ricochet and charges against Lucas were upgraded from Manslaughter to Murder.

Now, Kesha Tate's family is looking to make it illegal to shoot guns in residential areas of the county. Her family and other supporters have been going to city and county council meetings to propose that the new proposed law be adopted.

Cherokee County officials say, that they are gathering information and no decision has been made yet. In the city limits of Gaffney there is already a law on the books that prohibits the shooting in residential neighborhoods.

Nicholas Lucas remains in jail, as he faces murder and other charges related to the fatal shooting.
