Attorneys for Arkansas man charged in Capitol attack file several motions
THE ARKANSAS CW YOU HEY THANKS FOR JOINING US TONIGHT ON BRANDON EVANS IN NEWTON WITH THE ATTORNEYS FOR AN ARKANSAS MAN CHARGED IN CONNECTION TO THE JANUARY SIX CAPITOL ATTACK HAVE FILED SEVERAL MOTIONS IN THE CASE. WE HAVE 40/29 PHIL REED JOINING ME LIVE IN STUDIO WITH MORE ON WHAT’S IN THOSE DOCUMENTS. SO, BRANDI, YOU MAY REMEMBER THIS VIRAL PHOTO THAT YOU SEE BEHIND ME. IT SHOWS RICHARD BARNETT INSIDE HOUSE SPEAKER NANCY PELOSI’S OFFICES WITH HIS FEET ON A DESK DURING THE CAPITOL RIOT. SO AS ATTORNEYS FILED MOTIONS THIS WEEK, ONE MOTION ASKED THE COURT TO DISMISS THE CASE, SAYING THE JURY POOL IS TAINTED. IF THE JUDGE WON’T DISMISS THE CASE AGAINST 60 YEAR OLD RICHARD BARNETT OF GRAVETT, THE ATTORNEY ASKED FOR A CHANGE OF VENUE TO GET THE TRIAL OUT OF WASHINGTON, D.C.. THEY ALSO FILED A MOTION TO DROP ONE OF THE COUNTS AGAINST BARNETT IS THE ONE COUNT SAYING HE ATTEMPTED TOIMPEDE AN OFFICIAL PROCEEDING. THEY SAY BARNETT WASN’T INSIDE THE CAPITOL UNTIL AFTER CONGRESS WAS EVACUATED. THEY ARGUE THAT BARNETT WALKED OVER TO THE CAPITOL AFTER FORMER PRESIDENT TRUMP’S SPEECH, AT WHICH POINT HE WAS SWEPT INSIDE OF THE CAPITOL WHEN THE DOORS OPENED AND HE COULDN’T TURN AGAINST THE CROWD. IN THE COURT DOCUMENTS, HIS ATTORNEYS WRITE THAT HE WANDERED INTO PELOSI’S OFFICES WHILE LOOKING FOR A RESTROOM AND THAT HE LEFT PEACEFULLY WHEN ASKED TO DO SO. PROSECUTORS SAY HE YELLED AND CURSED AT OFFICERS ESCORTING HIM OUT BECAUSE HE WANTED TO GO BACK TO THE OFFICE AND GET THE FLAG HE HAD LEFT BEHIND. HE ALSO LEFT A NOTE FOR PELOSI, WHICH FEATURED A DEROGATORY WORD. IT ALSO SAYS IN THE MOTION THAT BARNETT’S ACTIONS, INCLUDING PUTTING HIS FEET ON THE DESK, CARRYING THE FLAG, THE ANGER IN HIS VOICE, AND THEN NOTING, LEFT FOR PELOSI WERE ALL PART OF POLITICAL PROTEST. SO BARNETT’S TRIAL WAS SUPPOSED TO START ON SEPTEMBER SIX, BUT IT WAS DELAYED. HIS NEW TRIAL DATE IS NOW SET FOR DECEMBER 12TH.

The attorneys for an Arkansas man charged in connection to the Jan. 6, 2021 capitol attack have filed several motions in the case.Richard Barnett’s attorneys filed for a motion asking for the courts to dismiss the case, saying the jury pool is taintedIf the judge won't dismiss the case against 60-year-old Richard Barnett of Gravette, the attorneys ask for a change of venue to get the trial out of Washington D.C. They also filed a motion to drop one of the counts against Barnett. It's the count alleging that he attempted to impede an official proceeding. They said Barnett wasn't inside the capitol until after congress was evacuatedThey argue that Barnett walked over to the capitol after former President Trump's speech at which point, he was swept inside of the capitol when the doors opened, and he couldn't turn against the crowd. In the court documents, his attorneys write that he wandered into House Speaker Nancy Pelosi’s offices while looking for a restroom and that he left peacefully when asked to do so. Prosecutors said he yelled and cursed at officers escorting him out because he wanted to go back to her office and get the flag he had left behind. Barnett's trial was supposed to start on Sept. 6 but was delayed. His new trial date is set for Dec. 12.

If the judge won't dismiss the case against 60-year-old Richard Barnett of Gravette, the attorneys ask for a change of venue to get the trial out of Washington D.C.
