Evaluation finds child porn suspect competent to stand trial

PIKEVILLE, Ky. — A judge has determined that a Pike County man is competent to stand trial in a child pornography case and recommended that his case proceed.

Robert Preston, 39, of Shelbiana, is charged in federal court with producing and possessing child porn and cyberstalking.



He had asked the court back in April to be allowed to plead guilty, saying he had reached a plea deal with prosecutors. However, his attorney said he had concerns that Preston was not in the right frame of mind to make that decision, which resulted in the competency evaluation.



That evaluation determined that Preston is competent for trial, and a magistrate judge has recommended the case proceed. A district judge must still approve that recommendation.

It is not clear whether or not Preston still wishes to enter a guilty plea.
