HOWEVER, THE PRELIMINARY HEARING SET FOR TODAY HAS BEEN PUSHED BACK ONCE AGAIN. THIS IS AS THE TWO SUSPECTS ARE STILL WAITING TO BE TRIED FIRST ON FEDERAL KIDNAPPING COUNTS. EARLIER THIS WEEK, STALLWORTH WHO IS CURRENTLY IN THE PICKENS COUNTY JAIL APPEARED IN FEDERAL COURT. HIS ATTORNEYS FILED A MOTION FOR HIM TO BE MOVED CLOSER TO BIRMINGHAM TO HAVE MORE TIME TO WORK WITH HIS ATTORNEY. IT WAS DENIED. THEY ALSO FILED A MOTION SAYING STATEMENTS STALLWORTH MADE OUTSIDE OF COURT WERE NOT ADMISSIBLE. THE STATEMENTS MADE TO POLICE THAT SUGGEST HE DENIED KNOWING MCKINNEY INCLUDE, "I CAN TALK TO YOU ALL, BUT ITS GOING TO BE THE SAME THING. I DON’T KNOW NOTHING ABOUT THIS BABY". AND, "I CAN’T BE UNDER ARREST FOR NO CAPITAL MURDER WHEN I DIDN’T TOUCH NO BABY". A RULING ON THOSE STATEMENTS IS EXPECTED IN THE NEXT FEW DAYS. AS FAR AS THE PRELIMINARY TRIAL HERE. Preliminary trial for suspects in Kamille 'Cupcake' McKinney kidnapping pushed back

The two suspects in the murder of Kamille “Cupcake” McKinney are set to be tried for capital murder in state court. However, the preliminary hearing set for Wednesday has been pushed back once again. Learn more in the video above.In October 2019, McKinney’s remains were found in a dumpster at an apartment complex in Center Point. Patrick Stallworth and Derick Brown were then charged with her death.The two suspects are still waiting to be tried first on federal kidnapping counts before trial in state court. Earlier this week, Stallworth who is currently in the Pickens County Jail appeared in federal court. He motioned to be moved closer to Birmingham to have more time to work with his attorney. The motion was denied. Stallworth also motioned statements he made outside of court were not admissible.The statements made to police that suggest he denied knowing McKinney include: “I can talk to y'all, but it’s going to be the same thing. I don’t know nothing about this baby,” Stallworth said. “I can’t be under arrest for no capital murder when I didn’t touch no baby.”A ruling on those statements is expected in the next few days.
