Man arrested after Giliberto's fatal shooting released from jail, court documents

A man arrested after a fatal shooting outside a popular late-night eatery in central Sioux Falls has been released from jail on bond nine months after the incident.

Isaac Mohammed Wali, 21, from Sioux Falls, had his bond conditions of release changed, which allowed him to bond out of jail on Friday, according to court documents. Wali's bond was initially set at $50,000 cash only, but after a hearing Friday, he was allowed to get out on a personal recognizance bond.

His charges stand at four counts of aggravated assault, one count of aggravated eluding and one count of obstruction, according to court documents.

Wali was arrested Nov. 7 after a shooting that left Garang Hakim Aluong, 37, dead and another one injured outside Giliberto's Mexican Taco Shop on Minnesota Avenue south of downtown Sioux Falls. 

The 21-year-old was never charged with the homicide, and police have yet to charge anyone else with killing Aluong.

Initially Wali was arrested for fleeing the scene after the shooting. He was also charged for aggravated assault on law enforcement officers, but that charge was dropped with his latest indictment. 

Days after the shooting, police would not confirm if Wali was a suspect in the homicide.

Wali nearly hit two Sioux Falls Police Department officers with his car as he left the scene of the shooting when police arrived. Police spokesperson Sam Clemens initially said Wali was present at the scene of the crime but was arrested for unrelated charges.

The court documents don't go into detail about how Wali was "involved" in the shooting.

After being questioned about the court documents saying Wali was involved in the shooting, Clemens told the Argus Leader on Tuesday afternoon that police "don't know" specifics about Wali's involvement.

Wali's newest bond findings and conditions of release state that an argument was made by his defense that no gun residue or link to a gun have been found, according to court documents.

The aggravated assault charges for Wali names two people as victims. The 21-year-old is noted to have used a firearm in the assaults.

Aluong is one of Wali's victim's for two of his aggravated assault charges but he has not been charged with his homicide, according to court documents.

Wali was released on bond from the Minnehaha County Jail on Friday. His next court date is a motions hearing on Aug. 22, according to court documents.
