REPORTER: ACCORDING TO COURT DOCUMENTS. THE DEFENDANT SPENT TWO WEEKS IN THE HOSPITAL ON A SEVERAL COMMITMENT. HE WAS RELEASED FROM THAT COMMITMENT ABOUT A WEEK BEFORE THIS MURDER. >> NODDING YES, THANK YOU. REPORTER: 22-YEAR-OLD RASHAWN SETTLES NODS HIS HEAD WHEN ASKED BY THE JUDGE IF HE'D LIKE A COURT-APPOINTED LAWYER. SETTLES IS CHARGED WITH MURDERING HIS GREAT AUNT 64-YEAR-OLD LINDA GILBERT ALLEGEDLY STABBING HER THREE TIMES IN THE NECK. THE CRIME HAPPENED JULY 31 INSIDE THE VICTIM'S HOME ON LORING STREET IN LOWELL, WHERE SETTLES WAS ALSO LIVING AT THE TIME. SETTLES IS BEING DEFENDED BY ATTORNEY LORENZO PEREZ. DO YOU HAVE A SENSE WHAT THE MOTIVE WAS WHAT LED UP TO THIS? >> I DON'T THINK ANYONE DOES. REPORTER: PROSECUTORS SAY THEY HAVE SURVEILLANCE VIDEO FROM NEARLY A DOZEN CAMERAS SHOWING SETTLES WALKING TO AND FROM THE HOME ON LORING STREET AROUND THE TIME OF THE MURDER. THE STATE POLICE AFFIDAVIT SAYS, AFTER KILLING GILBERT, RASHAWN TOOK AN INDIRECT ROUTE AWAY FROM THE MURDER SCENE TO AVOID LAW ENFORCEMENT. DURING HIS FLIGHT FROM THE SCENE HE CHANGED HIS APPEARANCE MULTIPLE TIMES FINALLY PUTTING ON ENTIRELY DIFFERENT CLOTHES AFTER SHOWERING AT LEO'S APARTMENT. IN ADDITION TO THE MURDER CHARGE, RASHAWN SETTLES IS ACCUSED OF BURGLARY FOR BREAKING INTO THE APARTMENT OF LEO NANEZ, HIS GRANDFATHER, AFTER THE MURDER OF LINDA GILBERT. LAST WEEK, STATE POLICE FOUND A BAG WITH CLOTHING THEY BELIEVE SETTLES WAS WEARING AT THE TIME OF THE MURDER THEY SAY THE VICTIM'S DNA IS ON THE CLOTHING. >>IT'S NOT THAT A DEFENSE DEVELOPS DAY NUMBER ONE, BUT IMMEDIATELY I THINK HE IS ON SURVEILLANCE CAMERA BECAUSE HE LIVES THERE, HE HAS BEEN LIVING THERE, SO THAT'S PERFECTLY UNDERSTANDABLE - AS WELL AS THE DNA. A Massachusetts man faced charges Monday in the stabbing death of his great aunt in Lowell. Rashawn Settles, 22, of Lowell, was arrested Saturday at the Saint's Campus of Lowell General Hospital. Settles had been civilly held at the hospital since Aug. 1.According to the DA's Office, surveillance video and DNA evidence tied Settles to the July 31 death of 64-year-old Linda Gilbert, also of Lowell.On July 31, Lowell police responded to a house on Loring Street shortly before 11:20 p.m. after receiving reports of an unresponsive woman inside. Gilbert was found inside the home with apparent trauma and taken to Lowell General Hospital, where she was pronounced dead.Prosecutors say they have surveillance video from nearly a dozen cameras showing Settles walking to and from the home on Loring Street around the time of the slaying. In addition to the murder charge, Rashawn Settles is accused of burglary for breaking into the apartment of Leo Nanez, his grandfather, after killing Gilbert. A State Police affidavit says:"After killing Gilbert, Rashawn took an indirect route away from the murder scene to avoid law enforcement. During his flight from the scene he changed his appearance multiple times … finally putting on entirely different clothes after showering at Leo's apartment."Last week, state police found a bag with clothing they believe Settles was wearing at the time of the slaying which they say has the victim's DNA is on the clothing."It's not that a defense develops day No. 1, but immediately I think he is on surveillance camera because he lives there, he has been living there, so that's perfectly understandable – as well as the DNA," said defense attorney Lorenzo Perez.The state's Office of the Chief Medical Examiner ruled Gilbert's death to be a homicide and that the cause of her death was multiple stab wounds.Settles was held without bail after his arraigned in Lowell District Court on charges of murder in his great-aunt's death and burglary at his grandfather's home.
